# Drafting the patent specification and claims

Source: https://luatbanquyen.com/en/services/patent-drafting · Updated: 2026-08-28

Turns a technical solution into a specification and a claim set broad enough to be worth having yet able to survive substantive examination.

A patent's scope lives in the claims, not the description. Draft too narrowly and competitors design around it; too broadly and prior art knocks it down. New matter cannot be added after filing, which makes this the step you do not get to redo.

- **Who may perform this:** Industrial property representative specialised in the relevant technical field
- **Timeline:** Typically 2–4 weeks for a complete specification, depending on complexity
- **How pricing works:** Quoted by technical field, number of claims and number of drawings.

## Deliverables

- A claim set with independent and dependent claims
- The abstract and the application form ready to file

## What you provide
